RAMSTRONG TERMS OF SERVICE AND TERMS OF USE

Welcome to RamStrong.

These Terms of Service and Terms of Use (“Terms”) govern your access to and use of the RamStrong mobile application, websites, products, services, content, features, tools, integrations, and related functionality (collectively, the “Services”).

RamStrong is developed and operated by Stellar Software Development LLC, an Ohio limited liability company (“Stellar Software Development,” “RamStrong,” “we,” “us,” or “our”).

These Terms constitute a legally binding agreement between you and Stellar Software Development LLC.

PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION REGARDING MEDICAL AND HEALTH DISCLAIMERS, AUTOMATICALLY RENEWING SUBSCRIPTIONS, DISCLAIMERS OF WARRANTIES, LIMITATIONS OF LIABILITY, BINDING ARBITRATION, A JURY TRIAL WAIVER, AND A CLASS ACTION WAIVER.

1. ACCEPTANCE OF TERMS

By downloading, installing, accessing, creating an account for, subscribing to, purchasing through, or otherwise using RamStrong, you acknowledge that you have read, understood, and agree to these Terms.

Your use of RamStrong is also subject to our:

  • Privacy Policy;
  • Consumer Health Data Privacy Notice, where applicable;
  • Subscription terms presented at purchase;
  • App-store terms applicable to your purchase or download; and
  • Any additional terms, notices, disclosures, or policies presented through RamStrong (“Additional Terms”).

If Additional Terms apply to a particular feature, your use of that feature constitutes acceptance of those Additional Terms.

You represent and warrant that:

  • You are at least eighteen (18) years old;
  • You have the legal capacity to enter into a binding agreement;
  • You are not prohibited from using RamStrong under applicable law;
  • You will comply with all applicable local, state, federal, and international laws and regulations;
  • Information you provide through RamStrong will be accurate to the best of your knowledge; and
  • You have read, understood, and agree to these Terms.

RamStrong is intended for adults and is not intended for individuals under eighteen (18) years of age.

2. IMPORTANT ARBITRATION AND CLASS ACTION NOTICE

PLEASE READ THE DISPUTE RESOLUTION PROVISIONS OF THESE TERMS CAREFULLY.

Except for certain disputes described below and to the fullest extent permitted by applicable law, you and Stellar Software Development LLC agree that disputes between you will be resolved through binding individual arbitration instead of a lawsuit in court.

You and Stellar Software Development LLC also agree, to the fullest extent permitted by applicable law, that claims will be brought only in an individual capacity and not as part of a class, collective, consolidated, mass, representative, or private-attorney-general proceeding.

You may opt out of the arbitration agreement as described in these Terms.

3. CHANGES TO THESE TERMS

RamStrong will evolve, and these Terms may need to change as our Services, technologies, functionality, business practices, or legal obligations change.

We reserve the right to modify these Terms from time to time.

When required by applicable law, we will provide reasonable notice of material changes through one or more methods, which may include:

  • A notice within RamStrong;
  • Email;
  • Our website;
  • Push notification; or
  • Another reasonable electronic method.

The “Last Updated” date at the beginning of these Terms identifies the most recent revision.

If you do not agree to revised Terms, you must stop using RamStrong.

Unless additional consent is required by law, your continued use of RamStrong after revised Terms become effective constitutes acceptance of the revised Terms.

4. ACCOUNT REGISTRATION

Certain RamStrong features may require you to create an account.

You agree to provide accurate, complete, and current registration information and to update that information when reasonably necessary.

You may not:

  • Create an account using another person’s identity without authorization;
  • Impersonate another person;
  • Provide materially false or fraudulent information;
  • Sell, transfer, rent, or assign your account without our written permission; or
  • Create or use an account if applicable law prohibits you from using RamStrong.

You are responsible for maintaining the confidentiality and security of your:

  • Username;
  • Password;
  • Authentication credentials;
  • Device;
  • Account; and
  • Other access credentials.

You are responsible for activity occurring through your account to the extent permitted by applicable law.

If you believe your account has been accessed without authorization, contact us promptly at:

5. THIRD-PARTY ACCOUNT SIGN-IN

RamStrong may allow you to create or access your account using authentication services provided by third parties, including Apple or Google.

If you choose to use a third-party account to access RamStrong, you authorize the transmission of information necessary to authenticate and maintain your RamStrong account in accordance with:

  • The permissions you grant;
  • The third party’s applicable terms and privacy practices; and
  • Our Privacy Policy.

Third-party authentication systems are independently operated.

You remain responsible for maintaining the security of your third-party accounts.

6. AGE REQUIREMENTS AND CHILDREN

RamStrong is intended only for individuals eighteen (18) years of age or older.

We do not knowingly permit individuals under eighteen to create RamStrong accounts.

If we learn that we have collected personal information directly from an individual under eighteen contrary to our policies or applicable law, we may delete the account and associated information, subject to applicable legal retention requirements.

7. RAMSTRONG DOES NOT PROVIDE MEDICAL ADVICE

RAMSTRONG IS A PERSONAL TRACKING, ORGANIZATIONAL, EDUCATIONAL, FITNESS, WELLNESS, AND INFORMATIONAL TOOL ONLY.

RAMSTRONG IS NOT A MEDICAL DEVICE, HEALTHCARE PROVIDER, PHARMACY, MEDICAL PRACTICE, TELEHEALTH PROVIDER, DIAGNOSTIC SERVICE, OR SUBSTITUTE FOR PROFESSIONAL MEDICAL CARE.

Nothing provided through RamStrong constitutes or should be interpreted as:

  • Medical advice;
  • Medical diagnosis;
  • Treatment;
  • Clinical guidance;
  • Prescription guidance;
  • Medication instructions;
  • Dosing instructions;
  • Injection instructions;
  • Treatment recommendations;
  • Pharmaceutical advice;
  • Nutritional therapy;
  • Professional fitness advice;
  • Professional mental-health advice; or
  • Any other professional healthcare advice.

This disclaimer applies to all RamStrong features, outputs, displays, calculations, information, and content, including:

  • Medication tracking;
  • GLP-1 tracking;
  • Peptide tracking;
  • Supplement tracking;
  • Reconstitution calculations;
  • Syringe calculations;
  • Injection-site tracking;
  • Body maps;
  • Side-effect tracking;
  • Symptom records;
  • Weight tracking;
  • Body measurements;
  • Progress photographs;
  • Nutrition tracking;
  • Hydration tracking;
  • Workout tracking;
  • Activity tracking;
  • Apple Health data;
  • Health Connect data;
  • Connected-device data;
  • Medication-level estimates;

  • Any future health, fitness, wellness, medication, or substance-related functionality.

8. RAMSTRONG DOES NOT DIAGNOSE OR TREAT

RamStrong does not diagnose, treat, cure, mitigate, or prevent any disease, illness, injury, or medical condition.

RamStrong does not determine whether any:

  • Prescription medication;
  • GLP-1 medication;
  • Peptide;
  • Supplement;
  • Vitamin;
  • Research compound;
  • Other substance;
  • Dosage;
  • Concentration;
  • Schedule;
  • Injection;
  • Diet;
  • Exercise program;
  • Treatment;
  • Protocol; or
  • Health-related activity

is safe, effective, appropriate, medically necessary, or suitable for you.

Only an appropriately qualified healthcare professional can evaluate your individual medical circumstances and provide medical advice.

9. RAMSTRONG DOES NOT PRESCRIBE, SELL, DISPENSE, OR RECOMMEND SUBSTANCES

RamStrong does not prescribe, dispense, compound, manufacture, sell, distribute, supply, administer, or facilitate the sale of:

  • Prescription medications;
  • GLP-1 medications;
  • Peptides;
  • Research compounds;
  • Supplements;
  • Controlled substances; or
  • Other pharmaceutical products or substances.

The presence of a medication, peptide, GLP-1 medication, supplement, compound, or other substance within RamStrong does not constitute:

  • An endorsement;
  • A recommendation;
  • A prescription;
  • A suggestion that you use the substance;
  • A representation that the substance is safe;
  • A representation that it is effective;
  • A representation that it is legal;
  • A representation that it is approved by the U.S. Food and Drug Administration;
  • A representation that it is intended for human use; or
  • A representation that it is appropriate for you.

RamStrong does not verify the:

  • Identity;
  • Authenticity;
  • Purity;
  • Sterility;
  • Concentration;
  • Strength;
  • Quality;
  • Composition;
  • Source;
  • Manufacturer;
  • Pharmacy;
  • Compounding pharmacy;
  • Legality;
  • Labeling;
  • Storage;
  • Expiration;
  • Safety; or
  • Effectiveness

of any substance you research, reference, photograph, enter, or track.

10. CONSULT A QUALIFIED HEALTHCARE PROFESSIONAL

You are solely responsible for consulting an appropriately licensed physician, pharmacist, registered dietitian, or other qualified healthcare professional before making decisions involving:

  • Prescription medications;
  • GLP-1 medications;
  • Peptides;
  • Research compounds;
  • Supplements;
  • Reconstitution;
  • Dosages;
  • Concentrations;
  • Syringe measurements;
  • Injection or administration;
  • Medication schedules;
  • Medication changes;
  • Side effects;
  • Symptoms;
  • Nutrition;
  • Weight loss;
  • Hydration;
  • Exercise; or
  • Other medical or health-related matters.

Never disregard professional medical advice or delay seeking professional medical care because of information obtained through RamStrong.

Reliance upon information provided through RamStrong is at your own risk.

11. NO PROFESSIONAL RELATIONSHIP

Use of RamStrong does not create a:

  • Physician-patient relationship;
  • Pharmacist-patient relationship;
  • Healthcare provider-patient relationship;
  • Dietitian-client relationship;
  • Trainer-client relationship;
  • Therapist-client relationship;
  • Advisor-client relationship;
  • Fiduciary relationship; or
  • Other professional relationship

between you and Stellar Software Development LLC, RamStrong, or any of our owners, members, officers, employees, contractors, affiliates, licensors, or service providers.

No medical professional reviews your information merely because you enter or synchronize information with RamStrong.

12. MEDICAL EMERGENCIES

RAMSTRONG IS NOT DESIGNED OR INTENDED FOR MEDICAL EMERGENCIES.

Do not rely upon RamStrong, its tracking features, reminders, notifications, calculations, reports, educational materials, connected health data, artificial intelligence features, if any, or customer-support services to determine whether emergency medical treatment is necessary.

If you believe you are experiencing a medical emergency, immediately call 911 or the appropriate emergency service in your location.

13. HIPAA AND CONSUMER HEALTH INFORMATION

RamStrong is designed primarily as a consumer-directed personal tracking, fitness, wellness, and organizational application.

Unless expressly agreed otherwise in a separate written agreement, Stellar Software Development LLC does not provide RamStrong on behalf of a physician, hospital, health plan, healthcare clearinghouse, or other HIPAA-covered entity.

Accordingly, information you voluntarily provide directly to RamStrong is not necessarily protected by the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”) in the same manner as medical records maintained by a healthcare provider or health plan.

Other federal and state privacy laws may apply to health-related information collected by consumer applications even where HIPAA does not apply.

Our collection, use, disclosure, retention, security, and deletion of personal information and health-related information are described more fully in our Privacy Policy and, where applicable, Consumer Health Data Privacy Notice.

14. PERSONAL USE AND USER RESPONSIBILITY

RamStrong is intended primarily for personal, non-commercial use.

You are solely responsible for:

  • Information you enter;
  • The accuracy of your records;
  • Medications and substances you choose to track;
  • The accuracy of quantities and concentrations you enter;
  • Independently verifying calculations;
  • Following instructions from your healthcare professionals;
  • Decisions you make based upon information displayed through RamStrong;
  • Safely handling and storing medications and substances;
  • Complying with applicable laws;
  • Maintaining appropriate independent records of important information;
  • Protecting your account and device;
  • Reviewing synchronized information for accuracy; and
  • Seeking professional advice where appropriate.

RamStrong is an organizational and informational tool. You remain responsible for your medical, medication, nutrition, fitness, and wellness decisions.

15. JURISDICTION AND LEGALITY OF SUBSTANCES

Laws governing medications, prescription products, peptides, compounded medications, research compounds, supplements, controlled substances, imports, and related products vary by jurisdiction.

You are solely responsible for determining and complying with applicable laws and regulations.

RamStrong does not represent that any substance referenced, listed, searchable, or trackable through the Services is:

  • Legal in your jurisdiction;
  • Available without a prescription;
  • Approved for human use;
  • Approved for a particular purpose;
  • Safe;
  • Authentic;
  • Properly manufactured; or
  • Appropriate for you.

You may not use RamStrong to facilitate the unlawful purchasing, selling, distribution, importation, trafficking, prescribing, or administration of any substance.

16. ASSUMPTION OF RISK

You acknowledge that medications, GLP-1 medications, peptides, supplements, injections, research compounds, diets, exercise programs, and other health-related activities may involve known and unknown risks.

Potential risks include, without limitation:

  • Side effects;
  • Adverse reactions;
  • Allergic reactions;
  • Drug interactions;
  • Contraindications;
  • Incorrect dosage;
  • Incorrect concentration;
  • Reconstitution errors;
  • Mathematical errors;
  • Incorrect administration;
  • Improper injection technique;
  • Infection;
  • Tissue damage;
  • Contamination;
  • Improper storage;
  • Product degradation;
  • Mislabeling;
  • Counterfeit products;
  • Unknown ingredients;
  • Impurities;
  • Compounding errors;
  • Nutritional deficiencies;
  • Dehydration;
  • Exercise injuries;
  • Health complications;
  • Risks not presently identified in scientific literature;
  • Serious injury; and
  • Death.

You assume responsibility for decisions and actions concerning substances, medications, injections, nutrition, exercise, and other health-related activities.

17. RECONSTITUTION AND DOSAGE CALCULATORS

RamStrong may provide mathematical tools allowing you to enter information such as:

  • Vial quantity;
  • Medication or peptide quantity;
  • Diluent volume;
  • Concentration;
  • Desired amount;
  • Syringe capacity;
  • Syringe markings; or
  • Other numerical values.

THESE TOOLS PERFORM MATHEMATICAL CALCULATIONS BASED UPON VALUES ENTERED BY YOU. THEY DO NOT DETERMINE OR RECOMMEND WHAT DOSE YOU SHOULD TAKE OR ADMINISTER.

Calculator outputs do not constitute:

  • Medical advice;
  • Dosing instructions;
  • Prescription guidance;
  • Treatment recommendations;
  • Administration instructions;
  • Confirmation of a prescribed dose; or
  • Confirmation that a particular amount is safe.

Results may be inaccurate because of:

  • Incorrect inputs;
  • Typographical errors;
  • Incorrect product information;
  • Incorrect concentration assumptions;
  • Unit-conversion errors;
  • Rounding;
  • Misunderstanding of syringe markings;
  • Software errors;
  • Incorrect vial labeling; or
  • Other circumstances.

By using a RamStrong calculator, you acknowledge and agree that:

  • RamStrong does not recommend any dose, medication, substance, schedule, or protocol;
  • You are responsible for entering accurate information;
  • You are responsible for independently verifying calculations;
  • You should follow instructions from an appropriately qualified healthcare professional or pharmacist; and
  • You should not rely exclusively upon RamStrong to determine how much of any medication or substance to administer.

To the fullest extent permitted by applicable law, Stellar Software Development LLC is not responsible for overdose, underdose, miscalculation, improper reconstitution, incorrect administration, medication error, or other consequences resulting from reliance upon calculator outputs.

18. INJECTION-SITE TRACKING AND BODY MAPS

RamStrong may provide body maps, injection records, injection-site tracking, or rotation indicators.

These features are visual organizational tools only.

They do not provide medical guidance concerning:

  • Where you should inject;
  • Injection technique;
  • Needle length;
  • Needle gauge;
  • Injection depth;
  • Injection frequency;
  • Site suitability;
  • Sterility;
  • Infection prevention;
  • Medication compatibility; or
  • Whether an injection should be administered.

These features cannot detect or prevent:

  • Infection;
  • Injury;
  • Bruising;
  • Tissue damage;
  • Incorrect administration;
  • Injection-site reactions; or
  • Adverse reactions.

Always follow instructions provided by your qualified healthcare professional, pharmacist, and applicable medication instructions.

19. MEDICATION, GLP-1, AND PEPTIDE TRACKING

Medication, GLP-1, peptide, supplement, and other substance records reflect information entered, selected, or imported into RamStrong.

RamStrong does not independently verify:

  • What medication or substance you are using;
  • Whether it was prescribed;
  • Your prescribed dosage;
  • Product concentration;
  • Authenticity;
  • Manufacturer;
  • Pharmacy;
  • Compounding pharmacy;
  • Administration schedule;
  • Storage requirements;
  • Expiration; or
  • Whether continued use is medically appropriate.

The ability to track a substance through RamStrong does not constitute an endorsement or recommendation of that substance.

20. SYMPTOMS AND SIDE-EFFECT TRACKING

Symptom and side-effect logs are personal organizational records.

RamStrong does not determine whether a symptom is:

  • Serious;
  • Medication-related;
  • An adverse drug event;
  • An allergic reaction;
  • Evidence of a medical condition; or
  • A medical emergency.

The absence of a warning or alert from RamStrong does not mean that a symptom is safe or medically insignificant.

Contact an appropriately qualified healthcare professional regarding symptoms or side effects.

21. WEIGHT, BODY MEASUREMENTS, AND PROGRESS TRACKING

Weight logs, BMI calculations, body measurements, trend charts, goals, percentages, milestones, projections, and progress comparisons are informational and organizational tools.

They do not constitute medical or clinical assessments.

Weight and body composition may be affected by numerous variables, and information displayed through RamStrong should not be interpreted as a determination of your overall health.

22. PROGRESS PHOTOS

Progress photographs and other images you upload are personal records.

RamStrong does not medically evaluate progress photographs unless a particular feature expressly states otherwise.

You are responsible for ensuring that you have the legal right and appropriate consent to upload photographs.

You may not upload photographs of another person without lawful authorization.

Do not upload another person’s intimate or sensitive photographs without their express consent.

23. NUTRITION TRACKING

Calorie targets, macronutrient values, protein goals, fiber goals, nutrition estimates, food records, and related information are informational and organizational tools.

They are not individualized dietary prescriptions or medical nutrition therapy.

Individual nutritional requirements can vary substantially.

Food and nutrition information displayed by RamStrong may originate from manufacturer or product information, third-party food databases, approved RamStrong Product Contributions, or information entered or corrected by users. Such information may be incomplete, outdated, inconsistent, or incorrect.

When accuracy is important, you should compare the information displayed in RamStrong with the current product packaging, Nutrition Facts label, manufacturer information, and guidance from an appropriately qualified healthcare professional. RamStrong does not guarantee that barcode results, serving sizes, calories, macronutrients, fiber, or other nutrition values are error-free.

Users with medical conditions, dietary restrictions, allergies, eating disorders, diabetes, kidney disease, cardiovascular disease, metabolic disorders, or other health concerns should follow guidance from an appropriately qualified healthcare professional.

24. HYDRATION TRACKING

Hydration records, water-intake goals, fluid estimates, and related functionality are general organizational tools.

Individual fluid needs vary substantially.

Certain medical conditions and medications may require fluid restriction or specialized hydration guidance.

Do not use RamStrong hydration estimates as a substitute for instructions from a qualified healthcare professional.

25. EXERCISE AND FITNESS TRACKING

Workout records, steps, activity information, estimated calories burned, fitness goals, exercise logs, and related functionality are informational and motivational tools.

Physical activity involves a risk of injury.

Consult an appropriately qualified healthcare professional before beginning or materially changing an exercise program when medically appropriate.

26. MEDICATION-LEVEL AND HALF-LIFE ESTIMATES

RamStrong may provide medication-level, half-life, peak-timing, elimination, or similar estimated displays.

Such information represents generalized mathematical estimates and does not constitute clinical measurement or laboratory testing.

Actual medication levels, absorption, elimination, and effects may differ substantially among individuals.

Variables may include:

  • Metabolism;
  • Kidney function;
  • Liver function;
  • Age;
  • Body composition;
  • Genetics;
  • Medical conditions;
  • Product formulation;
  • Absorption;
  • Route of administration;
  • Drug interactions;
  • Dose timing; and
  • Other biological factors.

Medication-level and half-life estimates must not be used to determine when or how much medication to administer.

27. REMINDERS AND NOTIFICATIONS

RamStrong may provide reminders, alerts, and push notifications for your convenience.

These features are not medical alarms, monitoring systems, or safety systems.

Notifications may be:

  • Delayed;
  • Duplicated;
  • Incorrect;
  • Blocked;
  • Suppressed;
  • Delivered to another device; or
  • Not delivered at all.

Notification delivery may be affected by device settings, operating-system behavior, network availability, battery status, notification permissions, Focus or Do Not Disturb settings, cloud services, or other circumstances beyond our control.

Do not rely exclusively upon RamStrong to remind you to take or administer medication.

You remain responsible for following instructions provided by your healthcare professional.

28. ACHIEVEMENTS, BADGES, STREAKS, AND RAM TRANSFORMATIONS

RamStrong may provide motivational and gamification functionality, including:

  • Badges;
  • Streaks;
  • Milestones;
  • Ram transformations;
  • Progress levels;
  • Challenges;
  • Achievements; and
  • Similar features.

These features are designed for motivation and engagement only.

They do not represent:

  • Medical improvement;
  • Medication effectiveness;
  • Treatment success;
  • Medical compliance;
  • Health status;
  • Safety; or
  • Professional evaluation.

29. REPORTS AND EXPORTS

RamStrong may permit you to generate, download, print, email, save, or otherwise share reports containing information associated with your account.

Reports are generated primarily from information entered, selected, calculated, or imported into RamStrong.

RamStrong does not independently verify all information contained in reports.

You are responsible for reviewing reports for accuracy before providing them to:

  • Physicians;
  • Pharmacists;
  • Dietitians;
  • Trainers;
  • Insurers;
  • Family members; or
  • Other third parties.

Once you export or share information outside RamStrong, the recipient’s handling of that information may be outside our control.

30. ARTIFICIAL INTELLIGENCE FEATURES

RamStrong may now or in the future offer features powered by artificial intelligence or machine learning (“AI Features”).

AI Features may allow you to provide text, images, questions, data, or other information (“Inputs”) and receive generated information (“Outputs”).

You acknowledge that artificial intelligence technologies are probabilistic and evolving.

Outputs may be:

  • Incorrect;
  • Incomplete;
  • Outdated;
  • Misleading;
  • Biased;
  • Inconsistent;
  • Unreliable;
  • Similar to outputs generated for other users; or
  • Inappropriate for your individual circumstances.

You agree that:

  • You are responsible for determining whether Outputs are accurate and appropriate before relying upon them;
  • You will independently verify important information;
  • You will not intentionally provide deceptive Inputs for the purpose of creating harmful or misleading Outputs;
  • Similar Inputs may result in similar Outputs for different users;
  • You obtain no rights in Outputs generated specifically for other users; and
  • AI Outputs do not constitute medical advice, diagnosis, treatment, prescription guidance, or dosing instructions.

AI FEATURES MUST NOT BE USED AS A SUBSTITUTE FOR A PHYSICIAN, PHARMACIST, OR OTHER QUALIFIED HEALTHCARE PROFESSIONAL.

AI Features are not intended for medical emergencies.

Specific AI Features may be subject to additional disclosures regarding third-party AI providers and data processing as described in our Privacy Policy.

31. RESEARCH AND EDUCATIONAL CONTENT

Any medication profile, peptide profile, GLP-1 information, research library, article, summary, educational resource, informational reference, or similar content offered through RamStrong is provided for general informational and educational purposes only.

Research and educational materials may become:

  • Outdated;
  • Incomplete;
  • Incorrect;
  • Simplified; or

32. APPLE HEALTH, HEALTHKIT, HEALTH CONNECT, AND CONNECTED HEALTH DATA

RamStrong integrates or may integrate with Apple Health, Apple’s HealthKit framework, Google Health Connect, and compatible third-party applications, devices, wearables, smart scales, fitness trackers, and other health or fitness services (collectively, “Connected Health Services”).

With your authorization, these integrations may allow RamStrong to read, receive, display, organize, synchronize, or, where specifically supported and authorized, write certain health, wellness, fitness, nutrition, activity, or body-measurement information.

The specific categories available to RamStrong depend upon:

  • Your device;
  • Your operating system;
  • The Connected Health Service;
  • Other applications and devices you use;
  • Features currently supported by RamStrong; and
  • Permissions you choose to grant.

RamStrong will request access to applicable health-data categories through the permission mechanisms provided by Apple Health, HealthKit, Health Connect, or the applicable Connected Health Service.

YOU CONTROL WHETHER RAMSTRONG RECEIVES ACCESS TO SUPPORTED HEALTH INFORMATION THROUGH THESE INTEGRATIONS.

You may change or revoke applicable permissions through your device, operating-system settings, Apple Health, Health Connect, or other applicable service settings.

Depending upon features you enable and permissions you grant, connected information may include categories such as:

  • Body weight;
  • Body-fat percentage;
  • Body mass index (BMI);
  • Lean body mass and other supported body-composition information;
  • Physical activity and step count;
  • Workouts, including supported workout type, duration, and timestamps;
  • Active energy/calories associated with supported activity or workout data;
  • Workout-associated heart-rate information, including supported average or maximum heart rate when available; and
  • Other supported health, fitness, or wellness information that RamStrong expressly identifies and for which you grant access.

The fact that a category is available through Apple Health, HealthKit, Health Connect, or another Connected Health Service does not mean RamStrong necessarily accesses or uses that category.

When you authorize Apple Health, RamStrong may perform an initial historical import of supported categories to establish or reconcile your RamStrong history and may thereafter perform incremental synchronization. Historical and ongoing imports can include information originally written to Apple Health by compatible smart scales, wearables, fitness trackers, or third-party applications.

Connected Health Data may be stored with your RamStrong account when reasonably necessary to provide account-based history, charts, dashboards, synchronization, and related tracking features. Revoking a connected-health permission may prevent future access but does not necessarily remove information already imported into RamStrong. Deletion of retained RamStrong account data is governed by the Privacy Policy and applicable account-deletion controls.

Connected Health Data, including Apple Health / HealthKit data, is not used to create Product Contributions or populate the shared RamStrong product database. Product Contributions are a separate, voluntary product-data feature described below.

Accuracy of Connected Health Data

Connected Health Data may originate from:

  • You;
  • Your mobile device;
  • Apple Health;
  • Health Connect;
  • Wearable devices;
  • Smart scales;
  • Fitness trackers;
  • Third-party applications;
  • Connected health or wellness devices; or
  • Other sources outside Stellar Software Development LLC’s control.

RamStrong does not independently verify the accuracy, completeness, authenticity, or reliability of Connected Health Data.

Connected Health Data may contain:

  • Measurement errors;
  • Device inaccuracies;
  • Synchronization delays;
  • Duplicate records;
  • Missing records;
  • Incorrect timestamps;
  • Incorrect units;
  • Conflicting information;
  • Third-party software errors;
  • User-entry errors; or
  • Other inaccuracies.

RamStrong may display, calculate, summarize, chart, organize, or otherwise process information received from Connected Health Services, but doing so does not mean Stellar Software Development LLC has independently verified that information.

No Medical Reliance

DO NOT RELY UPON RAMSTRONG, APPLE HEALTH, HEALTHKIT, HEALTH CONNECT, CONNECTED-DEVICE DATA, OR INFORMATION GENERATED FROM THAT DATA FOR MEDICAL EMERGENCIES, DIAGNOSIS, TREATMENT, PRESCRIPTION DECISIONS, MEDICATION DOSING, INJECTION DECISIONS, OR OTHER SAFETY-CRITICAL MEDICAL DECISIONS.

Connected Health Data and information derived from it are provided for personal tracking, informational, organizational, fitness, and wellness purposes only.

Third-Party Availability

Apple Health, HealthKit, Health Connect, and other Connected Health Services are provided by third parties and are not controlled by Stellar Software Development LLC.

Availability and operation may change because of:

  • Operating-system updates;
  • API changes;
  • Device compatibility;
  • Permission changes;
  • Third-party policies;
  • Third-party service interruptions; or
  • Discontinuation of functionality.

We do not guarantee that any particular integration will remain available indefinitely.

Our handling of Connected Health Data is further described in our Privacy Policy and applicable Consumer Health Data Privacy Notice.

33. USER CONTENT

“User Content” means information or materials you provide through RamStrong, including:

  • Health and wellness information;
  • Medication records;
  • Peptide records;
  • GLP-1 records;
  • Injection records;
  • Weight records;
  • Body measurements;
  • Progress photographs;
  • Meal photographs;
  • Notes;
  • Journal entries;
  • Nutrition information;
  • Hydration records;
  • Workout information;
  • Uploaded images;
  • Custom medication or substance entries;
  • Other tracking information; and
  • Other information you voluntarily provide.

You retain ownership of your User Content.

You grant Stellar Software Development LLC a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, display, technically modify, and otherwise use your User Content as reasonably necessary to:

  • Provide RamStrong;
  • Synchronize your information;
  • Display information to you;
  • Enable features you request;
  • Maintain and secure the Services;
  • Troubleshoot problems;
  • Provide customer support;
  • Maintain backups;
  • Prevent fraud or misuse; and
  • Perform activities otherwise described in our Privacy Policy.

This license does not transfer ownership of your User Content to us.

Nothing in these Terms gives Stellar Software Development LLC unrestricted permission to publicly disclose or use your private health information or private progress photographs for advertising.

You represent and warrant that:

  • You have the right to provide your User Content;
  • Your User Content does not violate applicable law;
  • Your User Content does not violate another person’s privacy, publicity, intellectual property, contractual, or other rights; and
  • You have obtained any authorization or consent necessary for information or images concerning another individual.

34. COMMUNITY PRODUCT DATABASE AND PRODUCT CONTRIBUTIONS

RamStrong may maintain a shared product and nutrition database to improve food search and barcode results. This feature is separate from your private food diary, health records, medication or peptide information, Connected Health Data, and other private account information.

Voluntary Participation

If you manually correct nutrition information for a barcode-associated product, RamStrong may ask whether you would like to submit the corrected product information to help improve results for other RamStrong users. Participation is voluntary. Selecting “No Thanks” does not prevent you from saving or logging the corrected information privately or otherwise using RamStrong.

A Product Contribution may include the product barcode or GTIN, product name, brand, serving quantity, serving unit, serving weight, serving text, calories, protein, carbohydrates, fat, fiber, source or provenance information, and information recording the applicable contribution-consent version. RamStrong does not currently collect photographs or videos through the Product Contribution feature.

Private Information Is Not Automatically Contributed

Your private food logs, saved meals, meal history, meal times, DailyLog records, body weight, goals, medication or peptide information, dose history, injection history, symptoms, Apple Health / HealthKit information, Health Connect information, steps, workouts, and other Health Data are not automatically submitted as Product Contributions.

License for Product Contributions

When you affirmatively submit a Product Contribution, you grant Stellar Software Development LLC a worldwide, non-exclusive, royalty-free, transferable and sublicensable license, for so long as reasonably necessary to operate and improve the Services, to host, store, reproduce, review, verify, correct, modify, standardize, combine, adapt, distribute, display, and otherwise use the submitted product and nutrition information for operating, maintaining, moderating, verifying, and improving RamStrong and its shared product database.

This license applies only to the product information you voluntarily contribute. It does not give Stellar Software Development LLC a license to publicly distribute your private food diary, private Health Data, medication history, Connected Health Data, or other private account information merely because you use RamStrong.

If submitted information is approved and incorporated into a separate, non-identifying shared product record, that approved product information may remain in the RamStrong product database after you withdraw a pending submission, stop using RamStrong, or delete your account.

Contributor Responsibilities

You represent and warrant that you have the right to provide the information you submit. You may not knowingly submit false, fraudulent, malicious, misleading, infringing, manipulated, or intentionally inaccurate product information; impersonate a manufacturer or other source; interfere with the integrity of the product database; or use Product Contributions to introduce harmful content or abuse the Services.

Moderation and Verification

Product Contributions may be reviewed, corrected, approved, rejected, superseded, combined, or removed by Stellar Software Development LLC. Submission does not guarantee publication or approval. Pending contributions are not automatically presented to other users as verified nutrition information.

Approved product records may be labeled “RamStrong Verified” or with similar wording. “RamStrong Verified” means that the record has been reviewed or approved through RamStrong’s product-data process. It does not mean that the product or nutrition information has been certified, endorsed, tested, or approved by the product manufacturer, the U.S. Food and Drug Administration, the U.S. Department of Agriculture, Apple, Google, or any other governmental or third-party organization.

Accuracy of Product and Nutrition Information

Product packaging, formulations, serving sizes, and nutrition information can change. Information obtained from community contributions, manufacturers, third-party databases, or other sources may contain errors, omissions, or outdated values. RamStrong does not guarantee the accuracy or completeness of any food-database record. You are responsible for checking current packaging or manufacturer information when accuracy is important, including for allergies, medical dietary restrictions, or health-related decisions.

Withdrawal and Account Deletion

You may request withdrawal of a pending Product Contribution by contacting [email protected]. We may verify that the request relates to your account before processing it.

When your RamStrong account is deleted, Product Contribution records associated with your account are deleted subject to applicable legal exceptions. Product and nutrition information that was already approved and incorporated into a separate shared product record may remain because the approved record does not retain the original contributor’s identity.

Third-Party Product Data

RamStrong may also display product and nutrition information obtained from third-party databases or services. Third-party information remains subject to applicable rights, licenses, attribution requirements, and provider terms. RamStrong does not intentionally represent third-party database information as independently contributed RamStrong product information.

35. DE-IDENTIFIED AND AGGREGATED INFORMATION

To the extent permitted by applicable law and as described in our Privacy Policy, Stellar Software Development LLC may create information that has been aggregated or de-identified so that it cannot reasonably be linked to an identifiable individual.

Such information may be used for lawful purposes, including:

  • Analytics;
  • Security;
  • Service operation;
  • Understanding usage patterns;
  • Product development; and
  • Improving RamStrong.

Where applicable consumer health-data laws impose additional requirements concerning de-identification, disclosure, sale, authorization, or use, Stellar Software Development LLC will comply with applicable legal requirements.

36. REVIEWS AND TESTIMONIALS

“Reviews and Testimonials” include ratings, reviews, testimonials, survey responses, success stories, and other comments or statements about RamStrong that you publicly post or voluntarily submit to us for promotional purposes.

By publicly posting or submitting a Review or Testimonial, you grant Stellar Software Development LLC a worldwide, non-exclusive, royalty-free license to reproduce, publish, display, distribute, adapt, and reasonably edit the Review or Testimonial for marketing and promotional purposes.

We may reasonably edit Reviews and Testimonials for:

  • Grammar;
  • Formatting;
  • Length; or
  • Clarity,

but we will not knowingly alter their material meaning.

This license may include your name, username, initials, profile image, or general location only to the extent you made that information part of the public Review or Testimonial or separately authorized its use.

THIS LICENSE DOES NOT AUTHORIZE US TO USE YOUR PRIVATE MEDICATION RECORDS, PRIVATE HEALTH INFORMATION, PRIVATE PROGRESS PHOTOGRAPHS, JOURNAL ENTRIES, OR OTHER PRIVATE USER CONTENT FOR ADVERTISING.

Separate authorization will be obtained where required before private information is used for promotional purposes.

You may ask us to discontinue future marketing use of a specific testimonial by contacting:

Such a request may not require us to recall materials already printed, distributed, or published before we received your request.

37. FEEDBACK AND SUGGESTIONS

If you voluntarily provide suggestions, feature requests, ideas, concepts, improvements, designs, comments, or other feedback concerning RamStrong (“Feedback”), you agree that Stellar Software Development LLC may:

  • Use;
  • Reproduce;
  • Modify;
  • Develop;
  • Commercialize;
  • Publish; and
  • Incorporate

that Feedback without restriction, attribution, approval, or compensation to you.

Submission of Feedback does not create a confidential, fiduciary, employment, partnership, agency, or compensation relationship.

38. RESTRICTIONS ON USE

You agree not to use RamStrong in any manner that:

  • Violates applicable law or regulation;
  • Infringes intellectual property rights;
  • Violates privacy or publicity rights;
  • Is fraudulent, deceptive, threatening, abusive, harmful, or malicious;
  • Facilitates unlawful distribution, purchase, sale, importation, or administration of substances;
  • Provides unauthorized medical services;
  • Misrepresents RamStrong content as professional medical advice;
  • Impersonates another person;
  • Compromises the security of your account or another person’s account;
  • Attempts to obtain another user’s password or authentication information;
  • Attempts unauthorized access to our systems, servers, networks, databases, or infrastructure;
  • Introduces viruses, malware, malicious code, or harmful software;
  • Circumvents subscription or payment systems;
  • Circumvents authentication, security, or access controls;
  • Uses automated bots, crawlers, scrapers, spiders, or similar systems without authorization;
  • Places an unreasonable load upon our infrastructure;
  • Reverse engineers, decompiles, disassembles, decodes, or attempts to derive source code except where such restriction is prohibited by applicable law;
  • Attempts to discover proprietary algorithms, databases, models, systems, or trade secrets;
  • Copies or stores substantial portions of RamStrong content without authorization;
  • Creates derivative works from RamStrong without authorization;
  • Uses RamStrong intellectual property commercially without authorization; or
  • Otherwise interferes with the proper operation of the Services.

Violation of these restrictions may result in suspension or termination.

We reserve the right to cooperate with law enforcement or regulatory authorities when required by law or reasonably necessary to protect our Services, users, or others.

39. INTELLECTUAL PROPERTY AND LICENSE

RamStrong and its associated intellectual property are owned by Stellar Software Development LLC or its licensors.

Protected materials may include:

  • RamStrong’s name;
  • Logos;
  • Ram characters;
  • Ram transformation artwork;
  • Illustrations;
  • Badges;
  • Icons;
  • Software;
  • Source code;
  • Object code;
  • Databases;
  • User interfaces;
  • Designs;
  • Workflows;
  • Graphics;
  • Text;
  • Documentation;
  • Calculators;
  • Proprietary systems;
  • Websites;
  • Branding; and
  • Other original or proprietary materials.

Subject to your compliance with these Terms, Stellar Software Development LLC grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to use RamStrong for your personal, non-commercial use.

RamStrong is licensed, not sold.

No ownership interest in RamStrong is transferred to you.

All rights not expressly granted are reserved by Stellar Software Development LLC and its licensors.

40. COPYRIGHT INFRINGEMENT

Stellar Software Development LLC respects intellectual property rights.

If you believe content made available through RamStrong infringes a copyright you own or are authorized to enforce, you may send a written copyright complaint to:

  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner; and
  • Your physical or electronic signature.

Where applicable, we may remove or disable access to allegedly infringing material and take appropriate action regarding repeat infringers.

If RamStrong later provides material public user-content functionality, Stellar Software Development LLC may adopt additional Digital Millennium Copyright Act procedures and designate an agent with the U.S. Copyright Office as appropriate.

41. THIRD-PARTY SERVICES AND LINKS

RamStrong may rely upon, integrate with, or provide access to third-party:

  • Websites;
  • Cloud providers;
  • Authentication providers;
  • App stores;
  • Payment platforms;
  • Subscription services;
  • Analytics providers;
  • Crash-reporting systems;
  • Artificial intelligence providers;
  • Apple Health;
  • HealthKit;
  • Health Connect;
  • Nutrition databases;
  • Push-notification systems;
  • Customer-support systems; or
  • Other external services.

Third-party services are governed by their own applicable terms and privacy practices.

Stellar Software Development LLC does not control third-party services and is not responsible for their:

  • Content;
  • Accuracy;
  • Availability;
  • Security;
  • Privacy practices;
  • Data handling;
  • Billing decisions;
  • Refund decisions;
  • Service changes;
  • Outages;
  • Errors;
  • Artificial intelligence outputs;
  • Policies; or
  • Discontinuation.

Your independent interactions or transactions with third parties are between you and those third parties.

42. INTERNET, MOBILE DATA, AND DEVICE REQUIREMENTS

Certain RamStrong functionality requires internet access, mobile data, device permissions, cloud services, or compatible hardware and software.

You are responsible for maintaining:

  • Internet access;
  • Mobile service;
  • A compatible device;
  • A supported operating system;
  • Necessary app permissions;
  • Adequate storage;
  • Appropriate notification settings; and
  • Appropriate device security.

You are responsible for applicable:

  • Carrier charges;
  • Roaming charges;
  • Internet fees;
  • Mobile-data charges; and
  • Other third-party costs.

RamStrong may be unavailable, delayed, limited, or interrupted because of:

  • Internet outages;
  • Mobile-network issues;
  • Operating-system restrictions;
  • Insufficient battery;
  • Insufficient storage;
  • Device settings;
  • App permissions;
  • Third-party outages;
  • Cloud-provider outages;
  • App-store restrictions; or
  • Other circumstances outside our reasonable control.

43. SUBSCRIPTIONS, PAID SERVICES, AND PAYMENT PROCESSING

RamStrong may provide both free and paid functionality.

Paid functionality may include:

  • Monthly subscriptions;
  • Annual subscriptions;
  • Premium features;
  • Free trials;
  • Promotional subscriptions;
  • In-app purchases; or
  • Other paid functionality disclosed before purchase.

The applicable price, subscription period, renewal terms, trial terms, and other material purchase conditions will be displayed before you complete a purchase.

Mobile App Purchases

RamStrong does not currently process subscription payments directly through the RamStrong or Stellar Software Development LLC website.

Paid subscriptions and in-app purchases made through the RamStrong mobile application will be processed through the applicable third-party app-store billing platform, including, as applicable:

  • The Apple App Store; or
  • Google Play.

Your purchase is also subject to the applicable app store’s payment, subscription, billing, cancellation, and refund terms.

Stellar Software Development LLC does not receive or store your complete payment-card number when your payment is processed entirely by the applicable app store.

Website

The RamStrong and Stellar Software Development LLC websites may provide information concerning:

  • RamStrong;
  • App functionality;
  • Pricing;
  • Subscription options;
  • Support;
  • Legal documents;
  • Privacy information; and
  • Links directing users to applicable app stores.

The website does not currently process RamStrong subscription payments directly.

Stellar Software Development LLC may introduce additional authorized payment methods in the future.

If we do, applicable payment, subscription, renewal, cancellation, refund, and other material terms will be disclosed before you complete a transaction through the applicable payment method.

44. AUTOMATICALLY RENEWING SUBSCRIPTIONS

Certain RamStrong subscriptions may automatically renew unless canceled.

Before purchasing an automatically renewing subscription, applicable information concerning:

  • Subscription price;
  • Billing period;
  • Renewal;
  • Trial period, if applicable; and
  • Cancellation

will be presented to you.

If you purchase an automatically renewing subscription through the Apple App Store or Google Play, your subscription will renew according to the applicable terms presented by that app store unless you cancel according to the platform’s requirements.

You authorize the applicable app-store payment provider to charge the payment method associated with your account for applicable subscription charges.

DELETING RAMSTRONG FROM YOUR DEVICE DOES NOT CANCEL AN ACTIVE SUBSCRIPTION.

DELETING YOUR RAMSTRONG ACCOUNT DOES NOT NECESSARILY CANCEL AN APP STORE OR GOOGLE PLAY SUBSCRIPTION.

You must separately cancel an active subscription through the platform through which you purchased it.

45. CANCELLATIONS AND REFUNDS

Subscriptions purchased through the Apple App Store or Google Play must generally be managed through the applicable app-store account.

Canceling a subscription generally prevents future renewals but ordinarily does not retroactively refund amounts already charged unless:

  • A refund is required by applicable law; or
  • The applicable app store grants a refund under its policies.

Refund requests for purchases processed by Apple or Google may be subject to the applicable company’s refund procedures.

Because Stellar Software Development LLC does not control Apple or Google’s independent payment systems, we cannot guarantee approval of an app-store refund request.

Nothing in these Terms limits refund, cancellation, or consumer-protection rights that cannot lawfully be waived.

46. FREE TRIALS AND PROMOTIONS

RamStrong may offer:

  • Free trials;
  • Introductory pricing;
  • Promotional subscriptions;
  • Discounts; or
  • Other promotional offers.

Eligibility, duration, pricing, conversion terms, and other conditions will be disclosed with the applicable offer.

If a free trial or promotional period automatically converts to a paid subscription, that fact and the applicable subscription terms will be presented before enrollment.

Unless otherwise required by law, you must cancel through the applicable subscription platform before the stated cancellation deadline to avoid the next subscription charge.

Promotional offers may be limited to eligible users and may not be combined unless expressly stated otherwise.

47. APPLE APP STORE TERMS

If you obtain RamStrong through Apple’s App Store:

  • These Terms are between you and Stellar Software Development LLC, not Apple Inc.;
  • Stellar Software Development LLC, not Apple, is responsible for RamStrong and its content;
  • RamStrong is licensed to you on a limited, non-exclusive, non-transferable basis, subject to applicable Apple terms;
  • You may use the application on Apple-branded products you own or control as permitted by applicable Apple rules;
  • Apple has no obligation to provide maintenance or support services for RamStrong;
  • In the event of an applicable warranty failure, remedies involving Apple are governed by applicable Apple terms and law;
  • Stellar Software Development LLC, not Apple, is responsible for addressing claims relating to RamStrong to the extent required by applicable law;
  • Stellar Software Development LLC, not Apple, is responsible for the investigation, defense, settlement, and discharge of applicable third-party intellectual-property claims concerning RamStrong;
  • You must comply with applicable third-party agreements when using RamStrong;
  • You represent that your use of RamStrong is not prohibited under applicable United States sanctions or export restrictions; and
  • Apple and its subsidiaries are third-party beneficiaries of these Apple-related provisions and may enforce them against you to the extent provided under applicable Apple terms.

If Apple’s standard end-user license agreement applies in addition to these Terms, it will apply to the extent required by Apple and applicable law.

48. GOOGLE PLAY TERMS

If you obtain RamStrong through Google Play:

  • These Terms are between you and Stellar Software Development LLC, not Google;
  • Google is not responsible for RamStrong or its content;
  • Your use of Google Play remains subject to applicable Google Play terms and policies;
  • Google may administer applicable subscription billing, cancellation, payment, and refund processes;
  • You are responsible for maintaining your applicable Google account; and
  • Stellar Software Development LLC is not responsible for independent Google account, payment, billing, refund, or store decisions.

49. SERVICE MODIFICATIONS AND UPDATES

RamStrong will evolve over time.

We may:

  • Add functionality;
  • Modify functionality;
  • Replace functionality;
  • Remove functionality;
  • Change designs;
  • Update databases;
  • Introduce usage limits;
  • Modify subscription offerings;
  • Release bug fixes;
  • Release security updates;
  • Release new versions;
  • Suspend functionality; or
  • Discontinue functionality.

We do not guarantee that a particular feature will remain available indefinitely.

Certain features may require the latest version of RamStrong or your operating system.

We do not guarantee perpetual compatibility with any particular:

  • Device;
  • Operating system;
  • App store;
  • Health platform;
  • Wearable;
  • Smart scale;
  • Third-party service; or
  • Hardware configuration.

50. BETA AND EXPERIMENTAL FEATURES

RamStrong may provide beta, preview, early-access, experimental, or test functionality (“Beta Features”).

Beta Features may:

  • Contain errors;
  • Be incomplete;
  • Produce inaccurate results;
  • Stop working;
  • Change substantially;
  • Lose information;
  • Be unstable; or

51. ACCOUNT TERMINATION AND DELETION

You may stop using RamStrong at any time.

Account deletion functionality will be provided in accordance with applicable law and applicable app-store requirements.

Deleting your RamStrong account may result in deletion of information associated with your account, subject to:

  • Our Privacy Policy;
  • Backup-retention practices;
  • Security requirements;
  • Fraud prevention;
  • Financial recordkeeping;
  • Legal obligations;
  • Dispute resolution; and
  • Other lawful retention requirements.

You should export information important to you before deleting your account where an export function is available.

We cannot guarantee that information can be recovered after account deletion.

Product Contribution records associated with your account are deleted as part of the RamStrong account-deletion process, subject to applicable legal exceptions. Product and nutrition information that was already reviewed, approved, and incorporated into a separate non-identifying shared RamStrong product record may remain after account deletion. Approved shared product records do not retain the identity of the original contributor.

Deleting your RamStrong account does not necessarily cancel an active Apple App Store or Google Play subscription.

You must separately cancel the subscription through the applicable platform.

52. SUSPENSION OR TERMINATION BY STELLAR SOFTWARE DEVELOPMENT LLC

We may suspend, restrict, or terminate your access to RamStrong when reasonably necessary, including when:

  • You violate these Terms;
  • You violate applicable law;
  • Fraud or abuse is suspected;
  • Your activity creates a security risk;
  • Unauthorized activity occurs;
  • We are required to act by law, regulation, court order, app-store requirement, or service-provider requirement; or
  • Continuing to provide the Services becomes legally, commercially, technically, or operationally impractical.

Upon termination, your right to use RamStrong ends.

Provisions that by their nature should survive termination will survive, including provisions regarding:

  • Outstanding payment obligations;
  • Intellectual property;
  • User Content;
  • Disclaimers;
  • Limitations of liability;
  • Indemnification;
  • Arbitration;
  • Dispute resolution;
  • Governing law; and
  • Other provisions intended to survive.

53. DATA AVAILABILITY AND BACKUPS

You should not use RamStrong as the sole permanent repository of information that is critical to your health or safety.

Information may become temporarily or permanently unavailable because of:

  • Device failures;
  • User error;
  • Software defects;
  • Account problems;
  • Synchronization failures;
  • Cloud outages;
  • Third-party failures;
  • Data corruption;
  • Service discontinuation; or
  • Other technical circumstances.

Maintain appropriate independent records of information that is important to you.

Although we may maintain backups or synchronization systems, we do not guarantee that every piece of User Content can always be recovered.

54. BUSINESS TRANSFERS

If Stellar Software Development LLC, RamStrong, or substantially relevant assets are involved in a:

  • Merger;
  • Acquisition;
  • Financing;
  • Reorganization;
  • Bankruptcy;
  • Sale of assets;
  • Assignment;
  • Change of control; or
  • Similar transaction,

accounts, contracts, operational information, intellectual property, and other applicable assets may be transferred to a successor or acquiring organization, subject to applicable law.

Personal information transferred as part of a business transaction will remain subject to applicable privacy requirements.

Where legally required, users will receive applicable notices, choices, consent requests, authorizations, deletion rights, or opt-out rights regarding materially different uses of personal information.

55. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, RAMSTRONG AND THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

STELLAR SOFTWARE DEVELOPMENT LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, SUCCESSORS, AND ASSIGNS DISCLAIM ALL EXPRESS, IMPLIED, STATUTORY, AND OTHER WARRANTIES, INCLUDING WARRANTIES OF:

  • MERCHANTABILITY;
  • FITNESS FOR A PARTICULAR PURPOSE;
  • TITLE;
  • ACCURACY;
  • RELIABILITY;
  • AVAILABILITY;
  • SECURITY;
  • QUIET ENJOYMENT; AND
  • NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • RAMSTRONG WILL ALWAYS BE AVAILABLE;
  • RAMSTRONG WILL BE UNINTERRUPTED;
  • RAMSTRONG WILL BE ERROR-FREE;
  • ALL INFORMATION WILL BE ACCURATE;
  • ALL CALCULATIONS WILL BE CORRECT;
  • ALL SYNCHRONIZED INFORMATION WILL BE ACCURATE;
  • EVERY NOTIFICATION WILL BE DELIVERED;
  • ALL DATA WILL ALWAYS REMAIN AVAILABLE;
  • ALL DEFECTS WILL BE CORRECTED;
  • AI OUTPUTS, IF OFFERED, WILL BE ACCURATE;
  • RAMSTRONG WILL REMAIN COMPATIBLE WITH EVERY DEVICE OR OPERATING SYSTEM;
  • APPLE HEALTH OR HEALTH CONNECT INTEGRATIONS WILL ALWAYS REMAIN AVAILABLE; OR
  • RAMSTRONG WILL PRODUCE ANY PARTICULAR HEALTH, FITNESS, WELLNESS, OR WEIGHT-LOSS RESULT.

WE MAKE NO REPRESENTATION OR WARRANTY CONCERNING THE SAFETY, LEGALITY, EFFICACY, PURITY, IDENTITY, AUTHENTICITY, DOSAGE, CONCENTRATION, STORAGE, LABELING, SOURCE, APPROVAL STATUS, OR AVAILABILITY OF ANY MEDICATION, GLP-1 PRODUCT, PEPTIDE, COMPOUND, SUPPLEMENT, OR OTHER SUBSTANCE REFERENCED OR TRACKED THROUGH RAMSTRONG.

56. NO GUARANTEE OF RESULTS

RamStrong does not guarantee:

  • Weight loss;
  • Fat loss;
  • Muscle gain;
  • Weight maintenance;
  • Improved fitness;
  • Improved laboratory values;
  • Improved health;
  • Medication effectiveness;
  • Reduced side effects;
  • Successful treatment;
  • Improved nutrition;
  • Improved hydration;
  • Improved sleep;
  • Achievement of a goal weight; or
  • Any other particular result or outcome.

Individual results vary.

Results or progress experienced by another RamStrong user do not mean that you will experience the same results.

57. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, STELLAR SOFTWARE DEVELOPMENT LLC, RAMSTRONG, AND THEIR MEMBERS, OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, DEVELOPERS, AGENTS, AFFILIATES, LICENSORS, SERVICE PROVIDERS, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES ARISING FROM OR RELATING TO RAMSTRONG OR THESE TERMS.

This includes damages arising from or relating to:

  • Your use of or inability to use RamStrong;
  • Personal injury;
  • Illness;
  • Adverse reactions;
  • Allergic reactions;
  • Overdose;
  • Underdose;
  • Incorrect dosage;
  • Incorrect reconstitution;
  • Incorrect concentration;
  • Incorrect administration;
  • Injection injuries;
  • Infection;
  • Medication errors;
  • Medication or peptide use;
  • Substance use;
  • Calculator outputs;
  • Incorrect user inputs;
  • Nutrition information;
  • Hydration information;
  • Exercise;
  • Artificial intelligence outputs;
  • Notifications;
  • Connected Health Data;
  • Apple Health;
  • HealthKit;
  • Health Connect;
  • Wearable or connected-device information;
  • Third-party services;
  • Data loss;
  • Device damage;
  • Service interruption;
  • Unauthorized account access;
  • Reports or exports;
  • Decisions made by a third party who receives an exported report;
  • Loss of profits;
  • Loss of goodwill;
  • Loss of use; or
  • Other intangible losses.

To the fullest extent permitted by applicable law, our total cumulative liability for all claims arising out of or relating to RamStrong or these Terms will not exceed the greater of:

(A) THE AMOUNT YOU ACTUALLY PAID FOR RAMSTRONG DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR

(B) ONE THOUSAND U.S. DOLLARS ($1,000.00).

Some jurisdictions do not permit certain exclusions or limitations of liability.

Where a limitation or exclusion cannot legally be applied, it will apply only to the maximum extent permitted by applicable law.

You acknowledge that the disclaimers and limitations contained in these Terms are a material basis upon which RamStrong is made available.

58. LIMITATION PERIOD FOR CLAIMS

To the fullest extent permitted by applicable law, any claim arising from or relating to RamStrong or these Terms must be commenced within one (1) year after the cause of action accrued.

If applicable law requires a longer limitation period that cannot legally be shortened by agreement, the legally required period will apply.

59. INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Stellar Software Development LLC, RamStrong, and their members, owners, officers, employees, contractors, developers, agents, affiliates, licensors, service providers, successors, and assigns from claims, liabilities, damages, losses, penalties, settlements, judgments, costs, and reasonable attorneys’ fees arising from or relating to:

  • Your unlawful use of RamStrong;
  • Your violation of these Terms;
  • Your violation of applicable law;
  • Your violation of another person’s rights;
  • User Content you provide;
  • Unauthorized information or photographs concerning another person;
  • Your misuse of RamStrong;
  • Your fraud, negligence, or willful misconduct;
  • Your unlawful purchase, sale, distribution, importation, or possession of substances; or
  • Your unauthorized use of RamStrong on behalf of another person.

We reserve the right to assume control of the defense of a matter subject to indemnification, in which case you agree to reasonably cooperate with our defense.

60. INFORMAL DISPUTE RESOLUTION

Before initiating arbitration or litigation against Stellar Software Development LLC, you agree to first contact us and attempt in good faith to resolve the dispute informally.

  • Your RamStrong account email, if applicable;
  • A reasonably detailed description of the dispute;

  • The relief you are requesting.

The parties will have at least thirty (30) days after receipt of the notice to attempt in good faith to resolve the dispute before arbitration or litigation is commenced, except where immediate injunctive relief is reasonably necessary.

61. BINDING INDIVIDUAL ARBITRATION

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Except as expressly provided below and to the fullest extent permitted by applicable law, disputes arising out of or relating to:

  • These Terms;
  • RamStrong;
  • Your account;
  • Your subscription;
  • Purchases;
  • Your use of the Services;
  • Content provided through the Services; or
  • Your relationship with Stellar Software Development LLC

will be resolved through binding individual arbitration rather than a lawsuit in court.

This arbitration agreement involves interstate commerce and is governed by the Federal Arbitration Act to the extent applicable.

Arbitration will be administered by the American Arbitration Association (“AAA”) under its applicable Consumer Arbitration Rules or successor rules.

The arbitration may be conducted remotely where permitted under applicable rules or as otherwise agreed or directed.

The arbitrator will have authority to award any remedy available to an individual claimant under applicable law that falls within the arbitrator’s authority.

Payment of filing fees, arbitration fees, and other arbitration costs will be governed by applicable AAA rules and applicable law.

Each party will ordinarily be responsible for its own attorneys’ fees unless an award of attorneys’ fees is authorized by applicable law or applicable arbitration rules.

Judgment upon an arbitration award may be entered in any court of competent jurisdiction.

62. SMALL CLAIMS COURT AND INJUNCTIVE RELIEF

Notwithstanding the arbitration agreement, either party may bring an eligible individual claim in small claims court.

Nothing in these Terms prevents either party from seeking temporary, preliminary, or other appropriate injunctive or equitable relief concerning:

  • Intellectual property infringement;
  • Misappropriation;
  • Unauthorized system access;
  • Security abuse;
  • Unauthorized use of proprietary information; or
  • Similar immediate harm.

Nothing in these Terms prevents you from contacting or filing a complaint with a governmental or regulatory authority.

63. CLASS ACTION AND REPRESENTATIVE ACTION WAIVER

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND STELLAR SOFTWARE DEVELOPMENT LLC AGREE THAT CLAIMS WILL BE ASSERTED ONLY ON AN INDIVIDUAL BASIS.

Neither party will seek to participate as a plaintiff, claimant, or class member in a purported:

  • Class action;
  • Collective action;
  • Consolidated action;
  • Mass action;
  • Private attorney general action; or
  • Representative proceeding.

Except where applicable law requires otherwise or the parties expressly agree, an arbitrator may not consolidate the claims of multiple individuals.

If a court determines that a portion of this waiver cannot legally be enforced as to a particular claim or remedy, that claim or remedy will proceed as required by applicable law while the remainder of the dispute-resolution provisions will remain enforceable to the fullest extent permitted by law.

64. JURY TRIAL WAIVER

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND STELLAR SOFTWARE DEVELOPMENT LLC KNOWINGLY AND VOLUNTARILY WAIVE THE RIGHT TO A TRIAL BY JURY FOR DISPUTES THAT ARE SUBJECT TO THIS ARBITRATION AGREEMENT OR THAT OTHERWISE PROCEED IN COURT WHERE SUCH A WAIVER IS LEGALLY ENFORCEABLE.

65. ARBITRATION OPT-OUT

You may opt out of the binding arbitration agreement by providing written notice within thirty (30) days after first accepting these Terms.

  • Your mailing address;
  • The email address associated with your RamStrong account, if applicable; and
  • A clear statement that you wish to opt out of the RamStrong arbitration agreement.

Opting out of arbitration does not affect the validity or enforceability of the remaining provisions of these Terms.

66. GOVERNING LAW AND VENUE

These Terms are governed by the Federal Arbitration Act where applicable, applicable federal law, and the laws of the State of Ohio, without regard to Ohio’s conflict-of-law principles.

For disputes properly proceeding in court rather than arbitration, you and Stellar Software Development LLC consent to personal jurisdiction and venue in an appropriate state court located in Trumbull County, Ohio, or the applicable federal court having jurisdiction over that geographic area, except where applicable law requires otherwise.

67. EXPORT CONTROLS AND SANCTIONS

You may not download, access, or use RamStrong in violation of applicable United States export-control, sanctions, or trade laws.

You represent that:

  • You are not prohibited from using RamStrong under applicable sanctions or restricted-party laws; and
  • Your use of RamStrong will comply with applicable export-control and trade restrictions.

68. FORCE MAJEURE

Stellar Software Development LLC will not be liable for failure, interruption, or delay caused by circumstances beyond our reasonable control, including:

  • Acts of God;
  • Natural disasters;
  • Severe weather;
  • Fire;
  • Flood;
  • War;
  • Terrorism;
  • Civil unrest;
  • Labor disruptions;
  • Government actions;
  • Regulatory actions;
  • Court orders;
  • Power failures;
  • Internet failures;
  • Telecommunications outages;
  • Cyberattacks;
  • Cloud-provider outages;
  • App-store restrictions;
  • Platform outages;
  • Third-party service failures;
  • Infrastructure failures;
  • Epidemics or pandemics; or
  • Other circumstances beyond our reasonable control.

69. ASSIGNMENT

You may not assign, transfer, or delegate these Terms, your rights under these Terms, your obligations under these Terms, or your RamStrong account without our prior written consent.

Stellar Software Development LLC may assign or transfer these Terms and related rights or obligations in connection with:

  • A merger;
  • Acquisition;
  • Reorganization;
  • Financing;
  • Asset sale;
  • Change of control;
  • Corporate restructuring; or
  • Other lawful business transaction.

These Terms will bind and benefit permitted successors and assigns.

70. SEVERABILITY

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

To the extent legally permitted, an invalid or unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intended purpose.

71. NO WAIVER

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.

A waiver concerning one provision or circumstance does not constitute a waiver of another provision or circumstance.

72. NO PARTNERSHIP, AGENCY, OR EMPLOYMENT RELATIONSHIP

Nothing in these Terms creates a:

  • Partnership;
  • Joint venture;
  • Franchise;
  • Employment relationship;
  • Agency relationship;
  • Fiduciary relationship; or
  • Similar relationship

between you and Stellar Software Development LLC.

You have no authority to bind Stellar Software Development LLC.

73. THIRD-PARTY BENEFICIARIES

Except as expressly provided regarding applicable Apple-related provisions or other provisions that expressly identify a third-party beneficiary, these Terms are not intended to create enforceable rights in any third party.

74. ENTIRE AGREEMENT

These Terms, together with:

  • The RamStrong Privacy Policy;
  • Any applicable Consumer Health Data Privacy Notice;
  • Applicable subscription terms;
  • Additional Terms presented through RamStrong; and
  • Other legally required notices and disclosures

constitute the complete agreement between you and Stellar Software Development LLC concerning your use of RamStrong.

They supersede prior or contemporaneous communications, representations, agreements, or understandings concerning the subject matter addressed by these Terms.

75. ELECTRONIC COMMUNICATIONS

By using RamStrong, you agree that notices, disclosures, agreements, and other communications may be provided electronically where permitted by applicable law.

Electronic communications may be provided through:

  • RamStrong;
  • Email;
  • Our website;
  • Account notifications;
  • Push notifications; or
  • Other reasonable electronic means.

You are responsible for maintaining a current email address associated with your RamStrong account.
